Narrated Anas:

A Jew crushed the head of a girl between two stones. The girl was asked who had crushed her head, and some names were mentioned before her, and when the name of the Jew was mentioned, she nodded agreeing. The Jew was captured and when he confessed, the Prophet (ﷺ) ordered that his head be crushed between two stones.

حَدَّثَنَا مُوسَى، حَدَّثَنَا هَمَّامٌ، عَنْ قَتَادَةَ، عَنْ أَنَسٍ ـ رضى الله عنه ـ أَنَّ يَهُودِيًّا، رَضَّ رَأْسَ جَارِيَةٍ بَيْنَ حَجَرَيْنِ، قِيلَ مَنْ فَعَلَ هَذَا بِكِ أَفُلاَنٌ، أَفُلاَنٌ حَتَّى سُمِّيَ الْيَهُودِيُّ فَأَوْمَتْ بِرَأْسِهَا، فَأُخِذَ الْيَهُودِيُّ فَاعْتَرَفَ، فَأَمَرَ بِهِ النَّبِيُّ صلى الله عليه وسلم فَرُضَّ رَأْسُهُ بَيْنَ حَجَرَيْنِ‏.‏

Narrated Anas:

Ar-Rabi, the daughter of An-Nadr broke the tooth of a girl, and the relatives of Ar-Rabi` requested the girl's relatives to accept the Irsh (compensation for wounds etc.) and forgive (the offender), but they refused. So, they went to the Prophet (ﷺ) who ordered them to bring about retaliation. Anas bin An-Nadr asked, "O Allah"; Apostle! Will the tooth of Ar-Rabi` be broken? No, by Him Who has sent you with the Truth, her tooth will not be broken." The Prophet (ﷺ) said, "O Anas! Allah"; law ordains retaliation." Later the relatives of the girl agreed and forgave her. The Prophet (ﷺ) said, "There are some of Allah's slaves who, if they take an oath by Allah, are responded to by Allah i.e. their oath is fulfilled). Anas added, "The people agreed and accepted the Irsh."

حَدَّثَنَا مُحَمَّدُ بْنُ عَبْدِ اللَّهِ الأَنْصَارِيُّ، قَالَ حَدَّثَنِي حُمَيْدٌ، أَنَّ أَنَسًا، حَدَّثَهُمْ أَنَّ الرُّبَيِّعَ ـ وَهْىَ ابْنَةُ النَّضْرِ ـ كَسَرَتْ ثَنِيَّةَ جَارِيَةٍ، فَطَلَبُوا الأَرْشَ وَطَلَبُوا الْعَفْوَ، فَأَبَوْا فَأَتَوُا النَّبِيَّ صلى الله عليه وسلم فَأَمَرَهُمْ بِالْقِصَاصِ‏.‏ فَقَالَ أَنَسُ بْنُ النَّضْرِ أَتُكْسَرُ ثَنِيَّةُ الرُّبَيِّعِ يَا رَسُولَ اللَّهِ لاَ وَالَّذِي بَعَثَكَ بِالْحَقِّ لاَ تُكْسَرُ ثَنِيَّتُهَا فَقَالَ ‏"‏ يَا أَنَسُ كِتَابُ اللَّهِ الْقِصَاصُ ‏"‏‏.‏ فَرَضِيَ الْقَوْمُ وَعَفَوْا فَقَالَ النَّبِيُّ صلى الله عليه وسلم ‏"‏ إِنَّ مِنْ عِبَادِ اللَّهِ مَنْ لَوْ أَقْسَمَ عَلَى اللَّهِ لأَبَرَّهُ ‏"‏‏.‏ زَادَ الْفَزَارِيُّ عَنْ حُمَيْدٍ عَنْ أَنَسٍ فَرَضِيَ الْقَوْمُ وَقَبِلُوا الأَرْشَ‏.‏

Narrated Anas:

A Jew crushed the head of a girl between two stones. She was asked, "Who has done so to you, soand- so? So-and-so?" Till the name of the Jew was mentioned, whereupon she nodded (in agreement). So the Jew was brought and was questioned till he confessed. The Prophet (ﷺ) then ordered that his head be crushed with stones.

حَدَّثَنَا حَسَّانُ بْنُ أَبِي عَبَّادٍ، حَدَّثَنَا هَمَّامٌ، عَنْ قَتَادَةَ، عَنْ أَنَسٍ ـ رضى الله عنه ـ أَنَّ يَهُوِدِيًّا، رَضَّ رَأْسَ جَارِيَةٍ بَيْنَ حَجَرَيْنِ، فَقِيلَ لَهَا مَنْ فَعَلَ بِكِ، أَفُلاَنٌ أَوْ فُلاَنٌ حَتَّى سُمِّيَ الْيَهُودِيُّ، فَأَوْمَأَتْ بِرَأْسِهَا، فَجِيءَ بِهِ، فَلَمْ يَزَلْ حَتَّى اعْتَرَفَ، فَأَمَرَ النَّبِيُّ صلى الله عليه وسلم فَرُضَّ رَأْسُهُ بِالْحِجَارَةِ‏.‏

Al-Bara' b. 'Azib reported:

There happened to pass by Allah's Apostle (ﷺ) a Jew blackened and lashed. Allah's Apostle (ﷺ) called them (the Jews) and said: Is this the punishment that you find in your Book (Torah) as a prescribed punishment for adultery? They said: Yes. He (the Holy Prophet) called one of the scholars amongst them and said: I ask you in the name of Allah Who sent down the Torah on Moses if that is the prescribed punishment for adultery that you find in your Book. He said: No. Had you not asked me in the name of Allah, I would not have given you this information. We find stoning to death (as punishment prescribed in the Torah). But this (crime) became quite common amongst our aristocratic class. So when we caught hold of any rich person (indulging in this offence) we spared him, but when we caught hold of a helpless person we imposed the prescribed punishment upon him. We then said: Let us argree (on a punishment) which we can inflict both upon the rich and the poor. So We decided to blacken the face with coal and flog as a substitute punishment for stoning. Thereupon Allah's Messenger (ﷺ) said: O Allah, I am the first to revive Thy command when they had made it dead. He then commanded and he (the offender) was stoned to death. Allah, the Majestic and Glorious, sent down (this verse):" O Messenger, (the behaviour of) those who vie with one another in denying the truth should not grieve you..." up to" is vouchsafed unto you, accept it" (v. 41) 2176 It was said (by the Jews): Go to Muhammad; it he commands you to blacken the face and award flogging (as punishment for adultery), then accept it, but it he gives verdict for stoning, then avoid it. It was (then) that Allah, the Majestic and Great, sent down (these verses):" And they who do not judge in accordance with what Allah has revealed are, indeed, deniers of the truth" (v. 44) ;" And they who do not judge in accordance with what Allah has revealed-they, they indeed are the wrongdoers" (v. 45) ;" And they who do not judge in accordance with what God has revealed-they are the iniquitous (v. 47). (All these verses) were revealed in connection with the non-believers.

حَدَّثَنَا يَحْيَى بْنُ يَحْيَى، وَأَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ كِلاَهُمَا عَنْ أَبِي مُعَاوِيَةَ، قَالَ يَحْيَى أَخْبَرَنَا أَبُو مُعَاوِيَةَ، عَنِ الأَعْمَشِ، عَنْ عَبْدِ اللَّهِ بْنِ مُرَّةَ، عَنِ الْبَرَاءِ بْنِ عَازِبٍ، قَالَ مُرَّ عَلَى النَّبِيِّ صلى الله عليه وسلم بِيَهُودِيٍّ مُحَمَّمًا مَجْلُودًا فَدَعَاهُمْ صلى الله عليه وسلم فَقَالَ ‏"‏ هَكَذَا تَجِدُونَ حَدَّ الزَّانِي فِي كِتَابِكُمْ ‏"‏ ‏.‏ قَالُوا نَعَمْ ‏.‏ فَدَعَا رَجُلاً مِنْ عُلَمَائِهِمْ فَقَالَ ‏"‏ أَنْشُدُكَ بِاللَّهِ الَّذِي أَنْزَلَ التَّوْرَاةَ عَلَى مُوسَى أَهَكَذَا تَجِدُونَ حَدَّ الزَّانِي فِي كِتَابِكُمْ ‏"‏ ‏.‏ قَالَ لاَ وَلَوْلاَ أَنَّكَ نَشَدْتَنِي بِهَذَا لَمْ أُخْبِرْكَ نَجِدُهُ الرَّجْمَ وَلَكِنَّهُ كَثُرَ فِي أَشْرَافِنَا فَكُنَّا إِذَا أَخَذْنَا الشَّرِيفَ تَرَكْنَاهُ وَإِذَا أَخَذْنَا الضَّعِيفَ أَقَمْنَا عَلَيْهِ الْحَدَّ قُلْنَا تَعَالَوْا فَلْنَجْتَمِعْ عَلَى شَىْءٍ نُقِيمُهُ عَلَى الشَّرِيفِ وَالْوَضِيعِ فَجَعَلْنَا التَّحْمِيمَ وَالْجَلْدَ مَكَانَ الرَّجْمِ ‏.‏ فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏"‏ اللَّهُمَّ إِنِّي أَوَّلُ مَنْ أَحْيَا أَمْرَكَ إِذْ أَمَاتُوهُ ‏"‏ ‏.‏ فَأَمَرَ بِهِ فَرُجِمَ فَأَنْزَلَ اللَّهُ عَزَّ وَجَلَّ ‏{‏ يَا أَيُّهَا الرَّسُولُ لاَ يَحْزُنْكَ الَّذِينَ يُسَارِعُونَ فِي الْكُفْرِ‏}‏ إِلَى قَوْلِهِ ‏{‏ إِنْ أُوتِيتُمْ هَذَا فَخُذُوهُ‏}‏ يَقُولُ ائْتُوا مُحَمَّدًا صلى الله عليه وسلم فَإِنْ أَمَرَكُمْ بِالتَّحْمِيمِ وَالْجَلْدِ فَخُذُوهُ وَإِنْ أَفْتَاكُمْ بِالرَّجْمِ فَاحْذَرُوا ‏.‏ فَأَنْزَلَ اللَّهُ تَعَالَى ‏{‏ وَمَنْ لَمْ يَحْكُمْ بِمَا أَنْزَلَ اللَّهُ فَأُولَئِكَ هُمُ الْكَافِرُونَ‏}‏ ‏{‏ وَمَنْ لَمْ يَحْكُمْ بِمَا أَنْزَلَ اللَّهُ فَأُولَئِكَ هُمُ الظَّالِمُونَ‏}‏ ‏{‏ وَمَنْ لَمْ يَحْكُمْ بِمَا أَنْزَلَ اللَّهُ فَأُولَئِكَ هُمُ الْفَاسِقُونَ‏}‏ فِي الْكُفَّارِ كُلُّهَا ‏.‏

Anas bin Malik narrated:

"Allah's Messenger only poked out their eyes because they had poked out the eyes of the camel driver." Abu 'Eisa said: This Hadfth is Gharib. We do not know anyone who mentioned it other than this shaikh, from Yazid bin Zurai. And it is in accordance with the meaning of Allah's saying: "And wounds equal for equal" It has been reported that Muhammad bin Sirin said: "The Prophet only did this to them before the legislated punishments were revealed."

حَدَّثَنَا الْفَضْلُ بْنُ سَهْلٍ الأَعْرَجُ الْبَغْدَادِيُّ، حَدَّثَنَا يَحْيَى بْنُ غَيْلاَنَ، قَالَ حَدَّثَنَا يَزِيدُ بْنُ زُرَيْعٍ، حَدَّثَنَا سُلَيْمَانُ التَّيْمِيُّ، عَنْ أَنَسِ بْنِ مَالِكٍ، قَالَ إِنَّمَا سَمَلَ النَّبِيُّ صلى الله عليه وسلم أَعْيُنَهُمْ لأَنَّهُمْ سَمَلُوا أَعْيُنَ الرُّعَاةِ ‏.‏ قَالَ أَبُو عِيسَى هَذَا حَدِيثٌ غَرِيبٌ لاَ نَعْلَمُ أَحَدًا ذَكَرَهُ غَيْرَ هَذَا الشَّيْخِ عَنْ يَزِيدَ بْنِ زُرَيْعٍ ‏.‏ وَهُوَ مَعْنَى قَوْلِهِ ‏:‏ ‏(‏ وَالْجُرُوحَ قِصَاصٌ ‏)‏ ‏.‏ وَقَدْ رُوِيَ عَنْ مُحَمَّدِ بْنِ سِيرِينَ قَالَ إِنَّمَا فَعَلَ بِهِمُ النَّبِيُّ صلى الله عليه وسلم هَذَا قَبْلَ أَنْ تَنْزِلَ الْحُدُودُ ‏.‏

Narrated 'Imran bin Husain:

"A man bit the hand of another man. The man who was bitten pulled his hand out, causing two of his incisors (teeth) to fall out. They brought their case of the Prophet (ﷺ). So he said: "One of you bites his brother like the stallion bites? There is no blood-money for you.' So Allah Most High revealed: Wounds, equal for equal."

حَدَّثَنَا عَلِيُّ بْنُ خَشْرَمٍ، أَنْبَأَنَا عِيسَى بْنُ يُونُسَ، عَنْ شُعْبَةَ، عَنْ قَتَادَةَ، قَالَ سَمِعْتُ زُرَارَةَ بْنَ أَوْفَى، يُحَدِّثُ عَنْ عِمْرَانَ بْنِ حُصَيْنٍ، أَنَّ رَجُلاً، عَضَّ يَدَ رَجُلٍ فَنَزَعَ يَدَهُ فَوَقَعَتْ ثَنِيَّتَاهُ فَاخْتَصَمُوا إِلَى النَّبِيِّ صلى الله عليه وسلم فَقَالَ ‏"‏ يَعَضُّ أَحَدُكُمْ أَخَاهُ كَمَا يَعَضُّ الْفَحْلُ لاَ دِيَةَ لَكَ ‏"‏ ‏.‏ فَأَنْزَلَ اللَّهُ ‏(‏وَالْجُرُوحَ قِصَاصٌ ‏)‏ ‏.‏ قَالَ وَفِي الْبَابِ عَنْ يَعْلَى بْنِ أُمَيَّةَ وَسَلَمَةَ بْنِ أُمَيَّةَ وَهُمَا أَخَوَانِ ‏.‏ قَالَ أَبُو عِيسَى حَدِيثُ عِمْرَانَ بْنِ حُصَيْنٍ حَدِيثٌ حَسَنٌ صَحِيحٌ ‏.‏

"The Prophet (ﷺ) would recite: 'Anin-nafsu Bin-Nafsi Wal-'Ainu Bil-'Aini'" (From 5:45)

حَدَّثَنَا أَبُو كُرَيْبٍ، حَدَّثَنَا ابْنُ الْمُبَارَكِ، عَنْ يُونُسَ بْنِ يَزِيدَ، عَنْ أَبِي عَلِيِّ بْنِ يَزِيدَ، عَنِ الزُّهْرِيِّ، عَنْ أَنَسِ بْنِ مَالِكٍ، أَنَّ النَّبِيَّ صلى الله عليه وسلم قَرَأَ‏(‏إِنَّ النَّفْسَ بِالنَّفْسِ وَالْعَيْنُ بِالْعَيْنِ ‏)‏
